Automatic Data Collection: FranklinWH energy storage systems automatically transmit operational data to our servers. This data collection occurs continuously and does not require you to use the FranklinWH App. By having a FranklinWH system installed at your property, you acknowledge that your system will transmit Energy System Data as described in this Policy.
Energy Data Sensitivity: Your energy consumption patterns can reveal sensitive information about your daily life, including when you are home, your sleep schedule, and your household activities. We treat this data with heightened care.
International Data Access: Your data may be accessed by FranklinWH personnel located outside the United States, including in China, Japan. See Section 5 for details.
We Do Not Sell Your Data: FranklinWH does not sell your personal data to anyone for any purpose. We only share your information as described in this Policy to provide our Services to you.

2.1 Automatic Telemetry Collection
Your FranklinWH system (aPower, aGate, and connected equipment) automatically transmits operational data to FranklinWH servers via your home internet connection. This transmission:
1. Occurs continuously (typically every few seconds to minutes)
2. Does not require the FranklinWH App to be installed or used
3. Cannot be disabled without disconnecting your system from the internet (which may void your warranty and disable remote support features)
4. Includes energy consumption, production, storage, and diagnostic data
2.2 Installation Partner Data Entry
When your system is installed, your Installation Partner enters information about you and your system into the FleetView platform, including your contact information, property details, and system configuration. Your Installation Partner retains ongoing access to monitor and service your system.
3. When Do We Share Your Information?
We share your personal information with the following categories of recipients:

If we cannot verify your identity, we will notify you and explain what additional information is needed. We cannot process requests we cannot verify.
8.2 Reasons We May Deny Your Request
We may deny or limit your request in certain circumstances, including when:
1. We cannot verify your identity
2. The request is manifestly unfounded or excessive (e.g., repetitive requests)
3. Fulfilling the request would violate applicable law or a legal obligation
4. The information is necessary to complete a transaction you requested

FranklinWH does not sell personal information for monetary consideration. We may share certain online identifiers with advertising partners through cookies, which may constitute "sharing" under California law. California Civil Code Section 1798.83 permits California residents to request information about disclosure of personal information to third parties for direct marketing. We do not disclose personal information to third parties for their direct marketing purposes.

Residents of Virginia, Colorado, Connecticut, Utah, Oregon, Montana, Texas, and other states with comprehensive privacy laws may have similar rights to those described for California residents in Section 10, including rights to access, correct, delete, and opt out of certain processing.
